Who we are

Keeper Moments ("we," "us," "our") is a custom photo product business operating at keepermoments.com and at in-person events. Our studio is in Carmel, Indiana.

Eligibility

You must be at least 18 years old to place an order. By placing an order, you confirm that you are old enough to enter into a binding contract.

Products and pricing

We sell custom photo products including photo magnets, trading cards, Mosaic Magnets, and posters. All products are made to order and handcrafted in our Carmel, Indiana studio.

Prices are listed in US dollars and are shown on the product pages of our site. We reserve the right to change prices at any time. The price you pay is the price displayed at checkout when you place your order.

We make reasonable efforts to display product photos, colors, and sizes accurately, but slight variation between the photos on the site and the final product is normal for any handmade good.

Placing an order

When you place an order, you submit an offer to buy a product. Your order is confirmed only when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion — for example, if we suspect fraud, if a product is unavailable, or if there's been a pricing error.

Photos you upload

When you upload a photo for a custom product, you confirm:

• You own the photo, or you have permission from the rights holder to use it for this purpose.
• The photo does not contain content that's illegal, hateful, obscene, or infringes on anyone else's rights.
• You grant us a limited license to reproduce and print the photo for the purpose of fulfilling your order.

We reserve the right to decline to print any photo that we believe violates these terms, and we'll refund you if we can't fulfill the order.

Use of your photos in marketing

Unless you opt out, you grant Keeper Moments a non-exclusive, royalty-free, worldwide license to use your uploaded photos and photos we take of your finished products in our marketing and promotional materials. This includes our website, social media accounts, email newsletters, printed materials, and advertising. This license continues for as long as we operate the business, and survives termination of this Terms of Service.

We promise that we will:

• Never sell your photos to third parties or license them for unrelated commercial use.
• Never use your photos in a way that misrepresents you, your family, or your event.
• Not use photos that contain identifiable minors without separate written consent from a parent or legal guardian, even if you've granted general marketing permission.
• Not include personally identifying details (full names, school names, addresses, contact info) when sharing customer photos in marketing without your separate explicit consent.

How to opt out: You can opt out at any time, either by checking the "Don't use my photo in marketing" box during checkout, or by emailing hello@keepermoments.com with your order ID. Upon receiving an opt-out request, we will remove your photos from active marketing materials (websites, social media accounts, email lists) within 30 days. We cannot recall printed materials, products already in distribution, or third-party reposts that have occurred prior to your opt-out request.

Payment

We accept payment through Stripe. By providing payment information, you represent that you are authorized to use the payment method. Your payment is processed securely by Stripe — we do not store your full credit card number on our servers.

Shipping and delivery

We handcraft orders in Carmel, Indiana and ship via USPS and UPS. Standard production time is 3 business days from photo approval; for orders placed during peak periods (such as event pre-orders), production may take 5–7 business days.

Delivery time after shipment depends on your location and the carrier. We provide tracking information when your order ships. We are not responsible for carrier delays, lost packages in transit, or delivery to an incorrect address you provided.

Returns and refunds

Because our products are custom-made from your photos, we do not accept returns of items that were made correctly per your order.

If your order arrives damaged or we made a mistake, email us at hello@keepermoments.com within 14 days of delivery and we'll make it right — either by remaking your order or issuing a refund, at our discretion.

Cancellations

You may cancel an order before we begin production for a full refund. Once production has started, we cannot cancel the order. Contact us at hello@keepermoments.com as soon as possible if you need to cancel.

SMS text messages

If you provide your mobile phone number and opt in to SMS, we'll send you transactional text messages about your order (order confirmations, photo upload links, production updates, and shipping notifications). Message frequency varies, typically 3–6 messages per order. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help.

Keeper Moments is not liable for delayed or undelivered messages. Wireless carriers are not liable for delayed or undelivered messages.

Email communications

When you place an order, we'll send order-related emails to the address you provide. You can unsubscribe from any non-transactional emails we send using the link at the bottom of those emails.

Intellectual property

The Keeper Moments name, logo, website design, and content are owned by us. You may not copy, reproduce, or use them without our written permission.

Photos you upload remain your property. We only use them to fulfill your order.

Acceptable use

When using our website, you agree not to:

• Use the site for any illegal purpose
• Attempt to access areas of the site not intended for customers (such as admin tools)
• Upload viruses, malware, or any malicious code
• Interfere with or disrupt the site or its servers
• Submit photos or content that infringe on others' rights, or that are illegal, hateful, or obscene

Disclaimer of warranties

Our website and products are provided "as is." To the fullest extent allowed by law, we make no warranties beyond those explicitly stated in these terms. We do not guarantee that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of liability

To the fullest extent allowed by law, our total liability for any claim arising from your use of our site or products is limited to the amount you paid for the order in question. We are not liable for indirect, incidental, special, or consequential damages.

Privacy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using our site, you agree to our privacy practices.

Changes to these terms

We may update these terms from time to time. When we make material changes, we'll update the "Last updated" date at the top of this page. Your continued use of the site after changes are posted means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from these terms or your use of the site will be resolved in the state or federal courts located in Hamilton County, Indiana.
